Whereas it appears to us by an inquisition taken by virtue of her majesty's writ and of ad quod damnum issued in pursuance of our warrant given on the memorial of the mayor aldermen and burgesses of the borough of Kilkenny that the granting of a fair to be held in the city of Kilkenny on the second Wednesday in every month instead of the first Thursday in every month as at present with a fair eve on the Tuesday preceding  and also a fair to be held on the first day of May and the twenty-eight day of September in every year unless either of said last mentioned days should happen to fall on Sunday, and in such case on the day after, would be no damage, hurt or prejudice to her majesty or any of her majesty's subjects who may now have or hold fairs in the neighborhood of Kilkenny City.                 <text>This is the only royal charter in the corporation archives between the years 1609 and 1987. A grant of Charles I dating back to 16th September 1639 it confirms the corporation's rights to the church, precint and lands of St. John the Evangelist. This is an 18th century transcription of the original charter and is the largest in the archive containing a total of ten skins comprising over either. It has a black and white portrait of the kind together with the symbol of the garter along with lettering across the top. The charter begins as follows: &#13;
'James the second, by the grace God, king of England, Scotland, France and Ireland, defender of the faith, etc., to all whom these, our present letters, shall come, greeting. Whereas the city of Kilkenny was an ancient and populous city and the mayor and citizens of the city of Kilkenny had used and enjoyed different liberties, franchise, privileges, immunities and pre-eminencies, or at least pretended to have, use and enjoy them, and were used to be a body corporate and politic by the name of the mayor and citizens of Kilkenny, and whereas by a judgement of our court of exchequer of our kingdom of Ireland, all those liberties, franchises, privileges, immunities and pre- eminencies were seized into our hands, nevertheless, we willing that a sure and certain rule be henceforth and forever had in Kilkenny aforesaid, of, for and in the custody of our peace, and the rule and government of the same Kilkenny and of our people dwelling therein and others resorting thereto, and that Kilkenny aforesaid may and shall remain perpetually in future time a city of encouragement to the peace loving and quiet, of the support  for the good, and of dread and terror to those disposed towards evil, and also that our peace and other acts of justice and good government be better established and preserved.' </text>

                <text>The city charter of 1609 consists of five skins, with a clearly written Latin text in black ink. In contrast with the vivid colours of the 1608 charter, the opening initial and first line appear in plain black and white. There is a portrait of James I placed within the fine strapwork initial letter 'J'. He is portrayed as being seated, wearing a hat and he holds an orb and sceptre. The lion of England and unicorn of Scotland are also shown holding their respective national banners, also drawn in black and white. The top of the page has a floral scroll and the first skin is somewhat work and torn along the folds. &#13;
The charter concerns the duties, powers and responsibilities of the new body known as 'the mayor and citizens of Kilkenny'. It also notes how a new county, known as the county of the city of Kilkenny was created. The united boroughs of Irishtown and kilkenny together with the parishes of St. Canice's, St. Mary's, St. Patrick's, and St. John's were made into a county, distinct from the county of Kilkenny, which was to be known as the county of the city of Kilkenny. A new series of officers had to be appointed to supervise and regulate it's workings.  &#13;
Permission was granted to hold three weekly markets, on Tuesdays, Wednesdays and Saturdays, together with the court of pye-power, as well as three annual fairs to be held for three days each, centred on the feast of St. Canice (11th October), St. Patrick ( 17th March) and St. John the Baptist ( 24 June)&#13;
A society of the merchant staple was established which was to have the same rights as the similar staples in Dubln and Waterford. Edward Shee was appointed mayor of the staple of the city of Kilkenny, while John Roth Fitz Pierce and James Bryan, were to be its constables. </text>

                <text>Visually, this is one of the most attractive charters in the collection. It consists of three skins covered with a tightly written latin text in dark ink. The opening sentence is beautifully illustrated and shows the king enthroned, holding a sword and and sceptre, with the words 'In my defense God defend me' placed below. There are three coat of arms, separated by the rose of England and the thistle of Scotland, flanked by the banners of England , supported by a lion, and of scotland, supported by a unicorn.&#13;
The charter is carefully set out with a series of clauses relating to the government of the town, the operation of the guilds, the urban courts and prison, the regulation of the markets and the ownership of communal property. Regarding the government of the town, the charter states that it should be governed by a common council consisting of eighteen ' chief burgesses' of whom the sovereign was to be one. Fourteen of these individuals are named: Thomas Ley, sovereign, Robert Rooth, Arthur Shee, Richard Ragget, Elias Shee, Henry Shee, Thomas Archer, Patrick Archer, Luke Shee, Edward Rooth, John Rooth FitzPierce, Nicholas Langton, Edward Shee and Walter Lawless. This was presumably the existing council of the day and their names reflect their seniority of election. One may notice that the spelling of 'Rooth' provides clear evidence of how the name 'Rothe' was pronounced in Kilkenny in the early seventeenth century. &#13;
